On 31st August 2020, the Hon’ble Supreme Court of India had fined Senior Advocate Prashant Bhushan of Rs. 1. He was held guilty of the contempt of Apex Court.
Reportedly, the Bar Council of Delhi has initiated proceedings against him alleging professional misconduct.
The Bar Council of India has directed Bar Council of Delhi to investigate the issue in accordance with law.
The Bar Council of India (BCI) has opined that the tweets by Advocate Prashant Bhushan which had triggered criminal contempt proceedings as well as the judgment convicting Bhushan for contempt needs a thorough study and examination.
The findings of said inquiry proceedings would decide the further course of action and culpability may result in Mr. Bhusan's disqualification from the bar Council rolls.
In this regard, the
relevant provisions of the Advocates' Act, 1961 cited in the BCI's press
release are Sections 24A and 35.
Section 24A deals with disqualification for enrollment whereas
Section 35 deals with punishment of advocates for misconduct.
Apparently, the BCI has unanimously resolved to direct the Bar Council of Delhi, where Advocate Prashant Bhushan is enrolled, to examine the matter and decide the same as expeditiously as possible.
The above decision was taken by Supreme Court in a meeting on 03 September 2020.
