Parliament Passes Criminal Procedure (Identification) Bill 2022 Allowing Collection Of Prisoners' Biometrics ( APR 06, 2022 )

The Rajya Sabha today passed the Criminal Procedure (Identification) Bill, 2022 which enables investigating officers to collect the biometric details of prisoners. The Bill was passed in the Lok Sabha on Monday, April 4. The Bill was passed in the Rajya Sabha by a voice-vote. An opposition proposal to refer the Bill to a select committee was defeated in vote. 

The Bill proposes to allow Police to collect finger impressions, palm prints impressions, footprint impressions, photographs, iris and retina scans, physical and biological samples. It also proposes the collection of behavioural attributes including signatures, handwriting or any other examination referred under Section 53 or Section 53A of CrPC.The record of measurements shall be retained for a period of 75 years from the date of collection.Under the present regime, the Police are permitted to take finger and footprint impressions of a limited category of convicts and non-convicted persons.

During the discussion today, Congress MP P. Chidambaram dubbed the Bill as "dangerous", leading to "involuntary confession" and is violative of Article 20 and 21. He said that it overlooks the Supreme Court's decisions in Selvi v. State of Karnataka, 2010 which prohibited administration of Narco Analysis, Polygraph Test and Brain Mapping as being violative of Privacy. It is also contrary to the judgment in Justice KS Puttaswamy v. Union of India, which recognized the right to privacy as a fundamental right.

It further provides that any resistance to taking of measurements will be an offence under Section 186 (obstructing public servant) of IPC, attracting a jail term of three months or fine up to Rs 500 or both. The government clarified that such persons, who are not convicted or arrested for crime against women or children or those who are in custody for an offence punishable with imprisonment for a period less than seven years, can deny permission to give their biological samples.

Establishment of Digital Banking Units (DBUs) ( APR 07, 2022 )

In pursuance of announcements made in the Union Budget 2022-23, guidelines have been prepared for setting up of Digital Banking Units (DBUs) by commercial banks on the basis of recommendations of a Working Group formed by RBI which included representatives of banks and Indian Banks' Association (IBA).

NCLT 

NCLT approves Tata Steel Mining's resolution plan for debt-laden Rohit Ferro-Tech ( APR 7, 2022 )

Tata Steel on Thursday said the Kolkata bench of the National Company Law Tribunal (NCLT) has approved the resolution plan submitted by its wholly-owned subsidiary Tata Steel Mining Limited, for the acquisition of debt-laden Rohit Ferro-Tech Limited.

 On June 6, 2021, Tata Steel had informed that the Committee of Creditors (CoC) in terms of the Corporate Insolvency Resolution Process of the Insolvency and Bankruptcy Code 2016, declared Tata Steel Mining Limited as the successful resolution applicant for the acquisition of Rohit Ferro-Tech Ltd, subject to necessary regulatory approvals including approval from the NCLT Kolkata bench. 

In a bid to augment its ferro alloys processing capacities, Tata Steel is also in the process to acquire Odisha-based Stork Ferro and Mineral Industries for Rs 155 crore in an all-cash deal.

PMLA case: Deshmukh kingpin behind conspiracy, misused position, says ED ( APR 7, 2022 )

The Enforcement Directorate on Thursday told the Bombay high court that Maharashtra's former home minister Anil Deshmukh was the 'mastermind and brain' behind the money laundering conspiracy and that he had misused his official position to amass wealth.

The agency also alleged that Deshmukh exercised undue influence to pass favourable transfers and postings of the police officials.The ED filed its affidavit in the high court in response to the bail plea of Deshmukh.

Deshmukh was arrested by the ED in November 2021, and is currently in judicial custody.

 The Nationalist Congress Party leader filed a petition in the high court after a special court rejected his bail plea earlier this month. He sought bail on grounds of his ailing health and termed the ED's case as false and frivolous.

ED questions NC leader Omar Abdullah in J&K Bank case, party says it's 'vicious vilification' ( APR 7, 2022 )

The Enforcement Directorate on Thursday (April 7) questioned former Jammu and Kashmir chief minister and National Conference (NC) leader Omar Abdullah in Delhi in connection with the J&K Bank case.

As per PTI, the officials said Omar Abdullah arrived at the ED's headquarters this morning where his statement is being recorded in connection with the purchase of a building by the J&K Bank about 12 years ago. They said the case was registered by the federal probe agency earlier this year.

 Calling the questioning "political in nature", the NC wrote on its Twitter handle that Abdullah will "cooperate as there is no wrongdoing on his part".

India supreme court ends proceedings against Italian marines - Gentiloni ( APR 7, 2022 )

India's supreme court has closed all the proceedings against two Italian marines, European Union commissioner Paolo Gentiloni said on Tuesday. 

Salvatore Girone and Massimiliano Latorre were arrested in February 2012 over the shooting of two fishermen off the southern Indian coast. They said the killings were accidental, as they mistook the fishermen for pirates and fired warning shots while on duty on the Italian oil tanker "Enrica Lexie".

"Supreme Court quashes criminal cases against Italian marines in Enrica Lexie case accepting compensation," Gentiloni posted on Twitter. "The case with India is closed. A success of Italian diplomacy," he added.

India plans to issue e-passports to its citizens starting this year: Muraleedharan ( apr 7, 2022 )

Union Minister of State for External Affairs V Muraleedharan on Thursday said that the government is planning to issue e-passports to its citizens, starting in 2022-23.

 Muraleedharan’s remarks came in Rajya Sabha in reply to a question on the government’s plans for the issuance of e-passports in the calendar year 2022 and its details. The MoS informed that the e-passport will be a combined paper and electronic passport, with an embedded Radio Frequency Identification (RFID) chip and antenna embedded as an inlay in the back cover.

Muraleedharan further said that the Ministry of External Affairs has entrusted the National Informatics Centre (NIC) with the technical responsibilities in the context of the issuance of e-passports.

China Issues Draft Financial Stability Law to Prevent Systemic Risks ( APR 7, 2022 )

China on Wednesday issued a draft law on financial stability in a bid to further strengthen safety nets to prevent systemic financial risks in the world's second biggest economy. China will establish a financial stability protection fund to beef up its ability to cope with major financial risks, and set up a comprehensive cross-agency mechanism for risk detection and disposal, the central bank said. 

China's economy is slowing amid a resurgence in COVID-19 cases, a sluggish property market, and the fallout from the Ukraine crisis, straining the finances of already heavily-indebted local governments. 

China's financial stability fund, to be used to tackle major systemic risks, would be financed by the country's financial institutions and financial infrastructure operators. The PBOC can also provide liquidity support to the fund when needed, according to the draft law.
