Supreme Court asks six petitioners challenging provisions of Places of Worship Act to file intervention application (JUL 29,2022)

The apex court was hearing petitions filed by retired Army officer Anil Kabotra, advocates Chandra Shekhar and Rudra Vikram Singh, Devkinandan Thakur Ji, Swami Jeetendranand Saraswati, and former Bharatiya Janata Party MP Chintamani Malviya. 

Kabotra has challenged the constitutional validity of sections 2, 3, and 4 of the 1991 Act contending that they violate the principles of secularism.  By making the impugned Act, Centre has arbitrarily created an irrational retrospective cut-off date, declared that character of places of worship shall be maintained as it was on 15 August, 1947, and no suit or proceeding shall lie in court in respect of disputes against encroachment done by barbaric invaders and lawbreakers and such proceeding shall stand abated, said the plea filed through advocate Ashwani Kumar Dubey.

Gujarat High Court directs CBIC to refund IGST on ocean freight within six weeks (JUL 29, 2022)

The decision comes after the levy of GST on ocean freight was struck down by the Supreme Court in case of Mohit Minerals.  Many importers had filed the refund claims after the Supreme Court order, but their claims are stuck.

Earlier in May this year, the Supreme Court held that if IGST is paid on freight which is included in the value of imported goods, levying tax again as a supply of service, was illegal.
