Supreme Court junks Supertech plea over ‘settlement’ order (DEC 16, 2022)

The Supreme Court on Thursday dismissed Supertech Realtors’ appeal against a Delhi High Court’s order that held that the one-time settlement (OTS) entered into between the consortium of banks and the relator is purely a contract and any alteration of its terms by the borrower can be done only through mutual consent.  

The company's account was classified as NPA in 2018 after it could not repay a loan of Rs 678 crore that was disbursed by the consortium of lenders comprising Union Bank of India, Bank of Maharashtra, Central Bank of India and Oriental Bank of Commerce for the 'Supernova' project in Noida, Uttar Pradesh.

Supreme Court comes to the rescue of man sentenced to 18 years in jail for serial electricity theft (DEC 16, 2022)

Setting aside the high court judgment, the SC on Friday ordered the release of the man sentenced to 18 years in jail in nine separate cases of electricity theft.  As per the trial court’s order of consecutive sentences, the person has to undergo 18 years of imprisonment in nine cases, although he had made a plea bargain.

Kerala High Court concerned as innocent persons becoming victims of false cases under SC/ST Act (DEC 16, 2022)

A bench of Justice A. Badhurudeen said it was shocking that many innocent persons are victims of false implication and, therefore, courts must pay great attention to the details when it comes to cases under the SC/ST Act.

The court made these observations while considering an appeal moved by a woman against the order of a Special Judge under the SC/ST (POA) Act that refused to grant her anticipatory bail in a crime alleging commission of offence punishable under Section 3(1)(s) of the SC/ST (POA) Act.
